The Government Is Reviewing Legal Changes for Renewable Energy. Support for Biomethane Plants and New Facilitation Measures for Investors on the Agenda
Up to 50 New Biomethane Plants and Simplified Procedures for Onshore Wind Companies — These solutions have been included in the draft amendment to the RES Act. On 14 July 2026, the Council of Ministers began analyzing the proposed legal changes. This is another step in shaping the framework that will influence the development of renewable energy sources in Poland. The Council of Ministers Begins Analysis of the Amendment Draft
On Tuesday, the Council of Ministers reviewed the draft amendment to the Act on Renewable Energy Sources and certain other acts, prepared by the Ministry of Climate and Environment. The document includes a range of legal changes affecting both large-scale investments and solutions for prosumers.
This is one of the stages of the legislative path. After the government’s analysis, the draft will proceed through subsequent steps. This means that the final shape of the regulations may still change.
Biomethane with a New Support System
One of the most important elements of the draft is the proposal to launch an auction-based support system for biomethane plants with a capacity exceeding 1 MW.
The new regulations aim to increase biomethane production and create conditions for further investments in this sector. The draft is intended to enable the development of up to 50 new installations, which could significantly increase the share of renewable gases in the national energy mix.
The project also includes provisions to streamline the functioning of infrastructure used for the transmission of biogas and biomethane. It also clarifies settlement rules between producers and the operator responsible for the support system.
Easier Investment in Wind Energy?
The second major area of change concerns onshore wind farms. The draft proposes simplifying planning procedures to accelerate the preparation of new investments. This mainly involves clarifying the rules for using integrated investment plans as a tool enabling the siting of wind farms.
According to the authors from the Ministry of Climate and Environment, the changes will streamline the investment process. At the same time, the participation of local communities in planning procedures will be maintained.
What Changes Will Affect Prosumers?
Owners of micro-PV installations and energy cooperatives should also pay attention to the upcoming amendment. Among the proposals are measures to facilitate the installation of home energy storage systems. Moreover, prosumers can expect greater transparency in billing, while energy cooperatives will see clearer regulations governing their operations.
Legislative Process Underway
Changes in the law do not take effect once the Council of Ministers completes its analysis. The final scope of amendments will only become clear after parliamentary work is completed and any potential corrections introduced at later stages of the procedure.
